STO 2010 CESTAT 7
Commercial Training or Coaching Service: Stay: Levy of Service Tax on activity of teaching mathematic through 'abacus' training program. In view of cited decision the applicant has made out a prima facie case for waiver of pre-deposit. Stay granted.
STO 2010 CESTAT 6
Refund: For the same set of service both the consignor and the appellant have paid Service Tax. All relevant documents including audited accounts, bills and challans and on the issue of unjust enrichment Chartered Accountant's certificate as well as certificate from the only client, have been submitted. No evidence contradicting the findings is produced by Revenue. Revenue appeal rejected.
STO 2010 CESTAT 4
Cenvat Credit: Cenvat credit on the Service Tax paid on catering /canteen services and Mediclaim Insurance services availed by the appellants for the staff is available.
STO 2010 CESTAT 3
Security Service: The quantification of Service Tax liability is to be arrived upon on the actual receipts and not on the Income Tax Returns. Matter remanded back.
